The country enacted its Law Regulating Remote Gaming and Remote Sports Betting in February 2024, following a two-year consultation process aimed at building a comprehensive legal structure for the online gambling and sports betting sectors.

Peru has reported the successful rollout of its new online gambling legislation, highlighting improved tax compliance and firm action taken against unlicensed operators.

The country enacted its Law Regulating Remote Gaming and Remote Sports Betting in February 2024, following a two-year consultation process aimed at building a comprehensive legal structure for the online gambling and sports betting sectors.

Oversight of the new regime has been led by MINCETUR, Peru’s Ministry of Foreign Trade and Tourism, which has played a central role in implementing the reforms.

To date, MINCETUR has authorised 60 technology platforms and registered 280 service providers, both domestic and international. The number of physical gaming and betting locations across the country has also grown to 4,516.

Under the new legislation, licensed operators are subject to a 12% tax on monthly net income, calculated after deducting platform maintenance costs. Additionally, Peruvian residents must pay a 1% consumption tax on every wager placed. However, this has been temporarily reduced to 0.3% until 1 July 2025 to support a smoother transition.

The new legal framework has also taken aim at black market operators, with significant penalties introduced for non-compliance. Those operating without a licence face fines of up to 990,000 soles (around £207,000), and could also face prison sentences of up to four years.

MINCETUR has been granted powers to block unlicensed websites and suspend payment services linked to illegal activity. Its enforcement efforts have already resulted in the removal of 15% of illegal gambling sites, with a 40% drop reported in the presence of unregulated digital operators.

With these moves, Peru has established itself as a serious player in the expanding Latin American market—becoming the third country in the region to implement a dedicated regulatory regime for online gambling.
